(IN Monday, the Appeal Tribunal %.-/announced its decision to allow the appeals of the London and North Eastern and London, Midland and Scottish railway companies against the action of the East Midland Licensing Authority in granting an A licence to Mr. 3. Y. Gimson (Messrs. Gimsou Transport Service); Rendell Street, Loughborough.

Mr. Gimson was a newcomer to the industry and made two applications for licences, the first of which was refused. An appeal was lodged, but abandoned. The second application, alleged to be to take over the business of a Mrs. l3rewin, who ran a service from Loughborough to Birmingham, was granted.

-.It was stated that Mrs. Brewin's business had been acquired for £10, and that Mr. Gimson converted a small loss on trading into a small profit. Mrs. Brewin had never applied for a licence and her vehicles had been seized under a hire-purchase agreement. She had been operating in the basic year.

Mr. Gimson was formerly a timber merchant, and he held that the railway service between Loughborough and Birmingham was inadequate. The railways showed that between these two points there were four passenger trains operated daily, on which goods could be carried, and consignments handed in at Loughborough were delivered at Birmingham on the same day or the next day. In upholding the appeal, the Tribunal awarded the L.N.E It ;,11:1 14s 4d. costs.

Following the announcement of this decision, the Tribunal heard the appeals of the L.M.S. and L.N.E.R. against a decision of the Metropolitan Deputy Licensing Authority to grant the variation of an A licence to Mr. C. J. Saunders (Messrs. C. J. Saunders and Son), 48, Cainberwell Grove, London, S.E.5. Decision was reserved.

The appeal of Barratt and Co., Ltd., Mayes Road,' London, N.22, against the Metropolitan Licensing Authority's refusal of a B licence was also heard this week ; this cast is exclusively reported on page 777 of this issue.

The hearing of the appeal of Mr. Frank Axford (Swanscombe Transport Co.); Swanscomhe, against the refusal' of the Metropolitan Deputy Licensing Authority to grant an A licence was scheduled to commence yesterday (Thursday) afternoon. The Southern Railway Co. was the respondent.
