Which of the following most accurately describes the problem?

• Redland Aggregates was last week reminded by the courts to look after its subcontractors after the company was fined £5,000 for failing to ensure the safety of an owner-driver.

The Crown Court hearing followed an accident last year when Ipswich owner-driver Harry Martinson was covered by molten tar at Redland's Barham site in Suffolk. The company was also ordered to pay £4,744 costs.

The prosecution was brought by the Health and Safety Executive which told Bury St Edmunds Crown Court that Redland had failed to ensure Martinson's safety.

Redland pleaded guilty.

After mistakenly half filling Martinson's tipper with bitumen the company told him to take the load to a dumping area. But he was given no instruction or help in the operation.

As Martinson tried to unload his left arm and legs were covered by the 160° Centigrade substance, He was unable to work for 22 weeks.

Since then Martinson has returned to work with Redland as an ownerdriver on contract and the company has issued a Code of Practice to prevent similar incidents.
