Which of the following most accurately describes the problem?

• A lorry driver made redundant by Renwick Freight (Scotland) Limited has been awarded £2,210 compensation for unfair dismissal after an Edinburgh Industrial tribunal rejected claims that his dismissal had been in accordance with an agreed procedure between the Road Haulage Association and the Transport and General Workers' Union.

The tribunal was told that Eric White had been employed as a Class I driver by William Swan (Contractors). The shares in that company were acquired by Renwick Freight which decided to dispose of vehicles and drivers.

Four drivers, including White, were selected for re dundancy. Ths■ugh there Were drivers with less service, the company chose White because of his past conduct.

'rhere was an agreed procedure for redundancy between the RI-IA and the T&GWLI. That stated that the principle of last-in first-out should apply, nut the employer and the union should explore other criteria.

The company argued that this agreement allowed it to take White's conduct into account. The tribunal, however, did not accept that contention, particularly where it was clear that the union representative had not accepted that conduct should be a criterion to apply in this case.
