The South Eastern & Metropolitan TC Christopher Heaps has refused to return an impounded truck used by London-based REJ Scaffolding without authority.

The 7.5-tonne vehicle had been stopped in a check at the Mackwall Tunnel on 14 May. The vehicle was laden and no 0licence disc was displayed. Gerald Tallowin informed the traffic examiner that he was a director of REJ Scaffolding, which owned the vehicle.

Enquires made by the traffic examiner confirmed that the firm did not hold an 0-licence, which Tallowin admitted when interviewed. The vehicle was then detained.

In a written statement, the company said that it was Its first year of trading and it was trying to get things right. The application for an 0-licence had been more complicated than It thought and it had taken a long time to get its application together. It was in the process of getting all the relevant paperwork when the vehicle was impounded.

It has since submitted its application together with all the relevant documents.

The TC said that the Traffic Area had received the application on 22 May. He understood that another traffic examiner had reported the same company with the same driver for not having an 0-licence a few weeks earlier.

Refusing to return the vehicle, he said that it was clear from all the evidence and previous warning that Tallowin was aware that his company was operating heavy goods vehicles Illegally.
