Shaw had denied not having an Operator's Licence; using a vehicle when a higher rate of duty was payable; driving a vehicle on the road with an incorrect class of licence; and using a vehicle without insurance at Uxbridge Magistrates Court, but admitted failing to use the tachograph record sheets.

Anthony Ostrin, prosecuting for VISA, said that Shaw's vehicle was stopped at a roadside check and was found to be loaded with rubble. No 0-licence was displayed, he was unable to produce tachograph records and the excise licence showed that the vehicle was licensed as a special vehicle when in fact it was a tipper. Shaw told the Court that he was not working for hire or reward and was only a fitter. He said the vehicle did not belong to him and he was net responsible for taxing it. He accepted that he was not using the tachograph, but believed at the time that he did not have to because the vehicle was a special vehicle. He also maintained that his driving licence covered the driving and he produced an insurance certificate.

District Judge Steven Day found all

cases proven against Shaw. He said that Shaw should not bend the rules to the point where they reached breaking point. Shaw was fortunate that he was not being disqualified, and in future he should get proper advice rather relying On friends in the pub.

He fined Shaw £200 for the insurance offence, with no separate penalty Imposed on the balance of the case. Shaw was also ordered to pay £400 costs.
