An Employment Tribunal has found that a Scottish driver fired after not finishing his rounds was unfairly

dismissed. Bridget Carter reports.

A SCOTTISH REFUSE truck driver has won almost £17,000 compensation after the Glasgow Employment Tribunal found he was unfairly dismissed.

Stephen Boyd, 35, from Johnstone, Renfrewshire, was sacked in April 2005 for not finishing his rounds and taking an unscheduled break.

The fact that he did not finish his duties caused complaints from the public thanks to a severely interrupted service.

The Tribunal heard that Boyd was seen with another driver in another vehicle without the crew members The crew members had gone to a bar.

Boyd said he told his union representative, who was also representing the crew members, that the men had jumped from the vehicle. He asked what they were doing but was told it was none of his business.

When Boyd was spotted by his supervisors, he did not give the real reason for not finishing his rounds because of concerns he would be bullied by his colleagues Boyd said a crew member called him at midnight spouting drunk and aggressive dialogue about how they believed he had told the supervisors where to find them. After that his car was deliberately scratched.

At his disciplinary hearing,Boyd did not tell the full story because of the intimidation he might face at work and he was also unaware he might be dismissed. After he was sacked, he unsuccessfully appealed the decision.

The Tribunal awarded Boyd £16.857. but said he was 15% responsible for his sacking.
