THE unauthorized change of base of five lorries from Penrith to Dundee, more than twoeyears ago, resulted in a penalty being imposed upon D. and D. Transport, Dundee, by Mr. Alex Robertson, Scottish Deputy Licensing Authority, at Dundee last week. He suspended one of the lorries for six months from October 11, but granted an application for an A licence to replace a special A licence.

Mr. Stanley Dolan, manager of the company, which is owned by his wife, said that the offence was committed unwittingly. After purchasing the ex-British Road Services lorries. he operated them for about six months from their Penrith base. Then he lost his accommodation there. He transferred them to the concern's headquarters at Dundee without applying for permission to change the base. He now realized his mistake.

Cross-examined by Mr. D. Brown, for British Railways, who objected, Mr. Dolan agreed that earnings shown were all in respect of vehicles based at Dundee. There were no earnings from operations at the authorized base at Penrith. He was unaware that the Little Strickland Trading Co., from whom he had bought the vehicles and whose accommodation he had used, were still in business at Penrith, and that they had been in business for some time as an agency for acquiring and reassigning special-A vehicles.
