Transport Tribunal on Tuesday their decision on an appeal which concerned breach of normal-user conditions. A. and E. Morris, Ltd., contested the West Midland Licensing Authority's deletion of two vehicles from their A licence. This was held to be a severe penalty which would "sterilize" until 1961 capital to the value of £6,000 represented by the two vehicles.

The company's normal user stipulated a 50-mile radius, but vehicles had regularly been running to Scotland. Mr. 3. R. C. Samuel-Gibbon, for the company, said that there had been no question of secrecy. Vehicles bore advertising to the effect that they journeyed to Scotland.

He felt that his clients had already suffered enough because the two deleted vehicles had been off the road for six months, and could not be the subject of an application for licence renewal for another two years.

, Mr. J. Edward Jones, for the British Transport Commission, who appeared as respondents, submitted that the company were still not certain about their normaluser conditions. He described the case as one in which entrants to the roadhaulage industry apparently had no knowledge of its specialized character.
