Which of the following most accurately describes the problem?

• A Dutch-owned haulage firm which partially flagged out its fleet has been prosecuted for running Dutch-registered vehicles that were not authorised on its UK Operator's Licence.

Felixstowe-based Dailyfresh Logistics UK pleaded guilty to two offences of using vehicles other than under the terms of its 0-licence. It was given a conditional discharge for 12 months and ordered to pay £450 costs.

John Hodgson, for the Vehicle Inspectorate, said the company had been set up by three Dutch operators and granted an 0-licence for 10 vehicles and 10 trailers. It then brought additional Dutch-registered trucks into the country.

"There are two ways you can operate: domestically or as an international operator undertaking cabotage," said Hodgson. ''What you can't do is tiring foreign registered vehicles over here to work as a subcontractor."

Richard Tinckler, for Dailyfresh, said the director's had taken advice from lawyers and were told that what they were proposing was neither definitely legal nor illegal.

The magistrates accepted that it was not a "cowboy organisation" and that there was no suggestion the the vers were not being properly controlled or maintained.
