Which of the following most accurately describes the problem?

• Macclesfield magistrates have ordered Wilmslow, Cheshirebased Holt Lloyd International to pay £220 in fines and costs for exceeding the permitted train weight of a vehicle, although neither axle was overloaded. Driver Terence Holt received an absolute discharge.

Defending, Guy Robson said that the train weight had only been exceeded by a relatively small amount and neither axle was overloaded. There was no explanation why the load exceeded the permitted train weight.

The driver had been on the same run daily for nine years and was not involved with the loading or unloading. He had been stopped in many spot checks but this was the first time he had been found to be overloaded.
