• A bid for a fivevehicle goods vehicle licence by M C Garages (Barnsley), trading as Majestic Transport and Majestic Coaches, has been adjourned.
North Eastern Deputy Traffic Commissioner Brian Horner said he was concerned about the company's maintenance, the issue of prohibition notices, a conviction, and directors' involvement with Deemelk Ltd.
For MC Garages, Colin Ward admitted that MC vehicles were mistakenly operated on Deemelk's licence. Once managers realised they could not legally do this, the operation was reduced to a level where only existing commitments could be maintained.
Horner commented on statements by principal Malcolm Cawthorne. The director said that he had resigned his Deemelk directorship, but yet he used Deemelk's licence.
A request that evidence be heard in private, as it concerned Cawthorne's medical condition, was granted by the Deputy Commissioner.
At the conclusion of that evidence, Horner said that he was adjourning both applications. These, he said, needed to be represented so that he could be assured of the company's ability to manage finance and maintenance.
Summing up, Horner said that so far, an inadequate picture had been painted of safety levels. There were gaps in the evidence which were very difficult to understand. He needed to know who was going to be responsible as CPC holder, who was going to be responsible for maintenance, and who was going to give expert evidence in relation to finance.
