• Mosley, West Midlands-based Samuel Magwood's licence was suspended after he failed to appear at five aublic inquiries, but it is allegec that one of his vehicles has since been seen on the road. Magwood had lost been due to appear before West Midland LA John Mervyn Pugh in April. When he failed to attend, Mervyn Pugh suspended his licence 1CM 5-11 May).

For Magwood, Paul Carless said that he had not been using his authorised operating centre. Magwood hod found an alternative site and an application and an advertisement had been prepared. Meanwhile, interim authority was sought for the use of the new centre.

Questioned by the LA, Magwood said the vehicle had not been on the road since the licence was suspended but had been used on site work since April. He was prepared to swear an affidavit to that effect.

Mervyn Pugh said that he would grant interim authority for the new operating centre once the application and the affidavit had been received. The application would be dealt with at a public inquiry.
