Which of the following most accurately describes the problem?

• The Transport Tribunal has dismissed the appeal of D. M. Turner of Freckleton, near Preston, against a decision of the North Western deputy LA (CM, 23 Feb.). The appellant's application was for an A licence to carry "general goods as -required". If granted he was to surrender an A licence conditioned: "Mainly building materials and farm produce within 25 miles of Blackburn and from Somerset, Devon and Cornwall."

This licence condition has been granted by the former deputy LA on 8 September 1966 after Turner had purchased the business of Clayton Haulage Co. of Blackburn. When making the grant the deputy LA had warned the applicant about his previous conduct as a carrier.

At the public inquiry when the application was refused, the applicant agreed that he had operated as a general haulier carrying anything for anyone. The Tribunal took the view that in taking over the Clayton business which was then going into liquidation the applicant was manoeuvring to obtain an A licence.

The deputy LA had formed the view that the applicant had totally disregarded the declaration of normal user he had made when he obtained the licence. The Tribunal in its written decision issued this week states: "These are strong words but in our view fully justified."

The Tribunal states that it is not the function of the Licensing Authority to follow meekly in. the wake of a haulier and grant a licence to cover whatever he finds the haulier has been doing.
