Which of the following most accurately describes the problem?

• EC poultry regulations made it impossible for Hygienic Pullet Deliveries to comply with environmental conditions imposed on its licence last November said Michael Carless, for the firm, when it appeared before West Midland Deputy Traffic Commissioner Gerrard Sullivan in an attempt to get the conditions relaxed.

HPD, of New Arley. Coventry, holds a licence for seven vehicles and five trailers, It wanted to relax conditions that prevented vehicles entering and leaving before 06:00hrs or after 18:00hrs Mondays to Fridays, allowing vehicles to enter and leave between 05:00hrs and 22:00hrs.

The proposals met with opposition from the occupiers of an adjacent bungalow, Henry and Sheila Hammond.

Carless said that the purpose of the application was to try and ensure that the firm abided by the environmental conditions. Under EC regulations live pullets could remain on a vehicle for up to 12 hours. Once the birds were loaded in the evening the only place for the vehicles was the firm's secure yard. To park in a layby or a pub car park was not in the interests of the public or the pullets, The local council had served a

planning enforcement notice on the firm and it had to vacate its present premises by 23 October, IIammond said that he and his

wife still opposed the change. Only three weeks after the November hearing, when it was said there would be no problems in complying with the conditions, they were breached.

Partner Sydney Finch said that because of animal rights activists, many poultry farms now had alarm systems and deliveries could only be made at specific times. The firm was looking for new premises.

Sullivan granted the application but with a warning that the conditions must be adhered to. He said he was satisfied that it would not exacerbate the environmental situation and it would enable the firm to abide by the law.
