• Although Alfred Hymas Ltd, a Yorkshire haulage firm, had been the subject of what the Yorkshire LA, Maj-Gen Sir John Potter, described as "one of the best maintenance reports he had ever seen", he still found it necessary to call the company to court under Section 69 in Leeds last week as the result of an overloading conviction and two immediate GV9s attracted earlier this year.

The LA stressed that the maintenance reports had made it clear that the company's maintenance, maintenance facilities, and conditions had all been first class. However, he said that two of the company's vehicles had received immediate prohibition notices in September and October of this year and the company itself, which was authorized to operate 28 vehicles and two trailers, had been prosecuted for an overloading offence in October this year.

Representing Alfred Hymas, Mr B. Kirby said the company was well aware that there had been a "slip up" in maintenance earlier this year but stringent measures had been taken to bring the system up to DoE requirements.

The LA referred to a number of overloading convictions which were recorded against Alfred Hymas in Darlington between 1968 and 1969.

Mr N. A. Hymas, managing director, said that the only explanation for the GV9s and overloading convictions was that the type of work which the company's vehicles were engaged in was of an arduous nature which brought about defects suddenly.

The LA decided to curtail the licence by suspending two vehicles, including the only one not yet acquired, and two trailers for a period of one month commencing December 11.

At the same hearing another Yorkshire company to be called before the LA under Section 69 was Hanson Transport Ltd, of Huddersfield.

Sir John said it was quite clear that in the recent past its statement of intention regarding its 0 licence application had not been fulfilled and therefore he decided to curtail the licence by five vehicles, three of which were already in possession, for twc months from December 14.
