Which of the following most accurately describes the problem?

• The Scottish LA, Mr A. B. Birnie, told an applicant, who was also appearing under Section 69, in Glasgow last week that the time was nearly past when an operator could say that he did not know what was involved in the undertaking he had given on his application form.

The operator, Cumbrae Sawmilling Co Ltd, of Glasgow, was seeking to continue its transitional licence for two vehicles and four trailers, with one vehicle and four trailers to be acquired. The company admitted four delayed and three immediate GV9s between December 1970 and September 1972. Mr S. Grier a vehicle examiner, said that the records were not satisfactory although forms based on those of the RHA were now being used. There were no records at all of trailer inspections, he added.

The LA said the company did know what was required and had been told exactly what was needed by letter and then by a vehicle examiner. It was not the duty of examiners to guide firms in this way but if they found the time to do so that was to their credit. Mr Birnie added that he was tempted to refuse the application but decided instead to defer his decision to this and in the meantime to curtail the licence for six months by the removal of one vehicle, leaving the firm with one vehicle and the existing trailers.
