Which of the following most accurately describes the problem?

• G. Stiller (Transport) Ltd. of Middleton St. George, Darlington, Co. Durham, was last week refused permission to carry out work formerly undertaken by a bankrupt haulier whose licence expires in 1971.

The firm's application to operate two attics for transporting steel ingots, forgings and castings mainly on Teesside and Tyneside was rejected by the Northern LA, Mr. J. T. Hanlon, at Darlington.

He also turned down its application to carry goods for clearing houses and other hauliers as required. Objections were lodged by BRS and British Railways.

Mr. Richard Merritt, representing the firm, said Stiller Transport had given Mr. H. Whitehouse, of Eaglescliffe, Co. Durham, parking and repair facilities at its premises before he went out of business in November, 1968. An offer of a goodwill payment of £400 to Mr. Whitehouse had been made, subject to the application being granted.

Mr. Whitehouse's licence, which still had two years to run, would be surrendered, said Mr. Merritt.

For the objectors, Mr. David Pattinson subrnitted that Stiller Transport's proposal amounted to an offer of £400 for Mr. Whitehouse's licence and insufficient evidence had been provided to prove there was any business to take over.

"The opportunity of obtaining another £400 for the creditors is not strong enough ground for granting this application," he said.

Mr. Hanlon ruled that the application could not be considered in the light of a takeover as £400 had no relation to the possible earnings of two vehicles.

He added: "From the figures presented, it cannot be regarded as a real haulage business. This transaction would amount to the sale of the licence, so the application is refused.
