WHALE TANKERS is to receive an Out of court "five figure cash sum" for infringement of copyright in its designs from Coventry-based Cleaver Lea.

Cleaver Lea is also to give an undertaking to the court not to make, sell, offer, advertise or expose as if for sale any gully emptier or tanker with parts which infringe Whale copyright. It must also undertake not to use the Whale trade marks Jetvac and Rotovac.

The settlement of the action also involves the redesign of key parts of a demonstration ranker. And sales literature depicting products which infringe Whale copyright must not be used.

Whale's managing director Mike Fisher has promised further action to curb what he describes as the "persistent copying of our designs by a small number of other Companies."

"We have now established that the copying of specific features of our products' design is actionable, and that a court may rule that a sum of money is payable to us for every copied item made and sold without our permission." he said.
