Which of the following most accurately describes the problem?

• The international licence held by John Clough, trading as Transportomatic of Stafford, has been renewed in respect of 12 vehicles without restriction despite representations from a number of nearby residents and a local taxi firm.

West Midland Deputy Licencing Authority Ivor Pugh heard Michael Carless, defending, say the previous licence authorised 10 vehicles. Three vehicles under the 0licence limit were also being operated. If authority was granted for two additional vehicles then the number of vehicles at the operating centre would not increase as the small vehicles would be replaced by larger ones. It was admitted that the premises had certain limitations and Clough hoped to move before the expiry of the lease in May 1989.

Two local residents complained of noise during the night and the early hours. They were concerned about safety, as vehicles had to reverse into the premises, and they complained about vehicles being parked in the street outside the depot. Evidence was given by Clough that he had operated from the site since 1979 and he physically could not get any more than the present number of vehicles into the operating centre.

Clough said that staff had been disciplined for parking vehicles in the street.

Pugh said he had no alternative but to grant the application since there was no material change. Access was clearly a matter for the Highway Authority and there were no statutory objections to the renewal of the licence
