Which of the following most accurately describes the problem?

• Hayden Powell and Trevor Waring, trading as Eastern Valley Transport, of Pontypool, have been granted aone-year licence for four vehicles and five trailers. This follows the surrender of the licence held by Waring's wife Kay, trading in the same name.

Alan 13oourlet, the new South Wales Deputy LA, was considering disciplinary action against the licence held by Mrs Waring following convictions for unauthorised use and using vehicles without excise licences.

For the firm, Paul Carless said the case had dragged on for a long time, with the licence holder not really wanting to be the operator.

Last February the company was fined £3,000 for VED offences. Carless said it had been in financial diffi

culties but the .111194, three vehicles • IL+ now operated

were all taxed at the full rate, and the tax discs paid for in cash.

Kay Waring said that the unauthorised use had been her fault. The company had not exceeded the number of vehicles authorised on the licence but had used another vehicle while one of its own was off the road.

A prohibition notice imposed in 1991 related to an old vehicle which was immediately scrapped, said Mrs Waring. All three artics currently in possession had been through the annual test within the past two months.

The DLA granted the new partnership a licence after hearing financial evidence in private.
