Which of the following most accurately describes the problem?

The first question and answer in CA January 24 may be thought to 131 misleading.

It should be made clear, I think, (par ticularly in a journal called Corn mercial Motor) that the provision re ferred to does not apply to commercia motor vehicle insurance policies.

It should also be made clear that thl cover given is not limited (as stated) ti Road Traffic Act liability only and tha valid claims made by occupants an included (as required by the Roe Traffic Act).

Perhaps it would have been better ti quote from a typical private car polic. wording which reads: "Section 1 Third Party Liability Indemnity to the Policyholder The insurer will indemnify thi Policyholder against:

(a) legal liability for death of or bodil. injury to any person and damage ti property arising from an acciden caused by through or in connectioi with

(i) any insured car (ii) the driving by the Policyholder c any private car or motor cycle no belonging to him and not hired to hin under a hire purchase agreement pro vided that the Policyholder is entitle by the current' Certificate of Moto Insurance to drive such private car o motor cycle".

It matters not that the vehicle beinr driven under (a) (ii) above may be un insured. The indemnity to the policy holder is still valid provided that tho useoto which the vehicle is being put h covered by the policy.

It is correct, however, to state — your answer does — that the policy holder (the driver) has no insuranci cover under his own policy for any los: of or damage to the vehicle which he driving under this provision.

It may be pertinent to remark, ir view of the fact that your excellen journal is read by private car flee operators, that normally (unlesi special arrangements are made) thil "Driving other cars" provision deleted when the policy is issued in tilt name of a firm or company.
