THE Transport Tribunal on Wednesday reserved its decision in an appeal by Sam Longson Ltd., hauliers of Chapel-enle-Frith against the grant of an 81-ton vehicle on A licence to F. Brown (Stockport) Ltd by the North Western deputy Licensing Authority. For Longson, Mr. E. Taylor said that in October, 1961, when Brown already had two vehicles on Contract A licence and eight on B licence, an A licence was granted to them for three vehicles totalling 12 tons; the normal user for these was: Bricks, quarry products and chemicals, Lancashire, Cheshire, Derbyshire, and North Wales and Midlands, for Higginbottom and Co. Ltd. only ", and the grant was a conversion from Contract A.

In April, 1962, he said, Brown was granted one 81-ton vehicle on A licence out of two applied for; the company was told by the L.A. to apply for the other vehicle when traffic increased and subcontractors were not available. This subsequent application was made in January, 1963. Brown had asked for the extra lorries because of new traffic in copperas for Higgin bottom (their main customer, part of whose work was clearing copperas, a by-product, from steel works) but, said Mr. Taylor, the figures put in did not prove that Brown's lorries were overextended; the question of increased traffic

was anticipatory and sub-contracting had been at a very low level. For Brown, Mr. J. A. Backhouse said that in his decision the L.A. had said he had no hesitation in granting the licence, and had accepted that traffic would build up. There was no evidence to show that objectors could offer any facilities in relation to new traffic for Brown which the L.A. had accepted.
