Which of the following most accurately describes the problem?

• The application by the Alruba Manufacturing Co of Burton-on-Trent for a new 0 licence to cover three vehicles and three trailers, to which an objection had been lodged by the RHA, was again adjourned in Nottingham on Wednesday, when the East Midland LA, Mr C. M. Sheridan, indicated that he would be unable to reach any decision until the company had produced its audited accounts for the present financial year.

On September 14 last year the initial hearing had been adjourned for similar reasons after Mr A. Rothera, representing the RHA, had suggested that Alruba should produce audited accounts and a list of creditors as evidence (CM September 17, 1971). However, the evidence produced was out-dated and did not give a clear picture of the situation.

The RHA has objected to the application on the grounds that the company has not sufficient finances to operate and maintain the vehicles required. It had been stated that the company had numerous creditors among them Hammond Eves and Co, and Granary Haulage Ltd, two transport companies.

Mr Rothera told the LA that neither of these creditors had been paid the money due to them and that if granted its application the company would be operating at the expense of the creditors.

Although the accounts produced showed a profit margin of £7500, this did not take into consideration an amount totalling £7000 owed to creditors.

Mr A. Johnson, a partner in the firm, told the LA that the situation was as not as bad as this and that various loans, an increase in business and stock had greatly reduced this amount.

On adjourning the hearing until new evidence could be produced, Mr Sheridan granted the company an interim licence authorizing two vehicles and three trailers to enable business to be carried on until the case was settled.
