Which of the following most accurately describes the problem?

• Two operators who specified a vehicle belonging to an owner-driver on their own operator's licence have each been fined £200 and ordered to pay prosecution costs of £50 by the Widnes magistrates.

Graham Marshall of Beaconsfield Road, Widnes and Alan Murty of Stanley Avenue, Great Sankey each pleaded guilty to aiding and abetting the operation of a vehicle without an operator's licence.

Prosecuting for the North Western traffic area, Bryan Green said a check on the tachograph records of the two operations revealed that a vehicle belonging to a selfemployed driver called Capewell had been specified on their licences and that Capewell had been employed to drive it. Capewell was deemed to be the user so the vehicle was no longer an authorised vehicle.

Defending both men John Backhouse said there would have been no problem if Capewell had driven another of the defendants' vehicles and another driver had driven Capewell's vehicle, or if the vehicle had been transferred to Capewell's wife and hired from her and then Capewell hired to drive it.
