Brierfieldbased Brian Nutter had been called before the North Western Deputy Traffic Commissioner Patrick Mulvenna following an unsatisfactory maintenance investigation and several prohibition notices.

After hearing that Nutter had obtained a new vehicle,the DTC adjourned the hearing for two months to enable the VI to carry out a further investigation.

Vehicle examiner Philip Harrison said Nutter used the vehicle to collect scrap cars. He carried out a further maintenance investigation in July, imposing an immediate prohibition on the vehicle for an incorrectly adjusted load sensing valve.

He also issued a defect notice for a number of items. There were no inspection records available and no record of any first use inspection. Not all defects were reported as they occurred or when found.

A fractured windscreen was not recorded in the defect book until the day of his visit despite Nutter's admission that it had been present for some time.

The DTC revoked Nutter's licence.
