Bradford-based Leo Sawrij has lost its 0-licence following convictions under the Environmental Protection Act. The company, which held a licence for six vehicles and six trailers, had been called before North Eastern Deputy Traffic Commissioner Mark Hinchliffe.
Last June it was convicted by the Bradford magistrates of two offences of keeping controlled waste on land not covered by a waste management licence and one offence of knowingly permitting abattoir effluent to enter a water course.
It was fined a total of £13,500, reduced to £10,500 on appeal. Director Danny Sawrij was convicted of similar offences and received fines of the same amount For the company, it was argued that similar offences could no longer occur because of a change in the law in the three years since they were discovered.
Revoking the licence with effect from 25 June, the DTC said a citizen must comply with the law as it was, and not as he hoped it would be in the future. Both the company and its sole director had more than one conviction for serious offences. The offences did not directly relate to road transport, but when assessing good repute that was not necessary.
The definition of a "road transport offence" in the legislation now included offences relating to the protection of the environment when that related to an operator's road transport activity. The company transported animal products, so these serious environmental offences were not disconnected from its main business activity In a number of important respects, he added, operators had an environment; responsibility. That primarily related to the operating centres, but notifiable conviction included convictions under Section 33 of th Environment Protection Act 1990. The env ronmental offences committed had seriou implications, and the clear legislative inter tion was that operators had to ensure th their transport activities did not hay adverse environmental consequences.
The DTC concluded: "I reach the conch. sion that the Operator's Licence of Le, Sawrij must be revoked with sadnesE because the company has held a Operator's Licence for some time."
