• Lorry driver Terence Waddingham has won £573 compensation for unfair dismissal, after being sacked by RH Thompson for taking 14 days holiday without permission — but a Birmingham industrial tribunal decided he was 80% to blame and assessed his compensation accordingly.

The tribunal heard that Waddingham had been employed by the company for five years. It decided the dismissal was unfair because no proper investigation had taken place before the sacking. Although he had taken the holiday despite being warned of the consequences of doing so, the warning had been given in such circumstances that its effect was blunted.
