Which of the following most accurately describes the problem?

• Mr. J. B. Wood, who completed a twoyear term as a member of the Transport Tribunal on May 3, sat with the Tribunal without jurisdiction at an appeal on Wednesday. Mr. Wood's reappointment had not been confirmed but the Tribunal Registrar had been informed by the Ministry of Transport on May 16 that it was awaiting final confirmation. It is understood that the Queen has now confirmed the appointment as the MoT told Commercial Motor this week that the matter was expected to be finalized in the course of the next few days. Before the appeal was opened the Tribunal President, Mr. G. D. Squibb QC, advised the advocates for both the appellant and the respondent of the situation. Neither objected to Mr. Wood sitting.
