Which of the following most accurately describes the problem?

THE M.O.W.T. has issued Conditions of Contract for Casual Haulage on tonnage or job rates, and the following is a precis.

They apply, except when varied in writing by the Minister, to all contracts for such haulage between carriers and the Minister afterAugust 1, and replace previous conditions.

The carrier undertakes to collect and deliver goods on his vehicles within reasonable time during ordinary working hours, and to advise breakdown or exceptional delay immediately to the nearest Unit or Area Office by tele phone or telegram. In the case of breakdown, the carrier will, unless otherwise instructed, substitute another vehicle at his own expense.

The carrier will not employ subcontractors without permission. If this, be granted, the carrier's, liability will remain as if the contract had been performed by him, his servants or agents. He must not employ a vehicle unless, it be insured against third-party risks.

The carrier will indemnify' the Minister against liability arising out of the carriage of goods or out of the contract between the Minister and. cus

tomer. In particular, he will.indemnify the Minister against the consequences of negligence, or that of any subcontractor. Claims arising out of goods in transit will be made direct to. the. carrier for settlement.

The carrier is employed as an inde-, pendent contractor, the Minister having no control over employees or vehicles, and the Minister cannot be responsible for loss, damage or personal.

injury. Any driver or second man accepting goods for carriage shall be deemed to do so with the authority of the carrier.

All rec,eipt notes are the property of the Minister, and must be returned, signed, to the Minister's office from which the orders were issued not later_ than seven days from delivery of goods, together with the carrier's . invoice. Payment will not be made unless these receipt notes are received.

Statements,, of account for every month must be rendered in. the first week of the succeeding month. They must identify each journey and each office from which the order was issued. If approved, payment will be made in

the last week of the month, .
