Which of the following most accurately describes the problem?

• A haulage contracting firm was fined £150 at Aberdeen Sheriff Court on October 27, after pleading guilty, through an agent, to allowing a lorry to be used with the steering gear badly maintained. The lorry was involved in an accident in which two elderly men were killed.

The charge alleged that Peter G. Barclay, contractor, Burnside St, Portsoy, Banffshire, on February 15, in Meldrum Drive, Newmachar, had used a lorry while steering gear fitted to the vehicle was not maintained in good and efficient working order and not properly adjusted, and a welding repair to the steering drag link failed.

The vehicle went onto the verge and knocked down two men. The fiscal said that the steering drag link had broken on February 5 in Portsoy, and had been welded by an expert who had expressed doubt about mending the link as it was made of hightensile steel. The link was refitted and used on several occasions, he said, before the accident.
