• All overloading offenders are liable to prosecution, the Vehicle Inspectorate has warned — even though last year examiners were advised to ease up on small overloads. Hauliers may think that they are still safe from prosecution up to 10% or one tonne over and above a permitted weight — but this is not the case says John Schock, head of the VI's traffic examiners. The decision to prosecute will depend on individual circumstances.

"Operators and drivers should take all possible care to ensure that vehicles are not overloaded at all rather than attempt to second guess the decision of an enforcement officer," says Schack.
