AN appeal lodged by Berresford's Motors, Ltd., against a decision of the West Midland Licensing Authority refusing. certain modifications when granting an application to. continue a group of excursions and tours from Leek, has been dismissed with costs. Three modifications were proposed. One of these was granted in full, one was partly granted and the third, the subject of the appeal, was refused.

For the appellant, Mr. I. R. C. Samuel-Gibbon declared that the concern produced evidence of lively business in tours and excursions. The Licensing Authority's decision had been contrary to the weight of evidence produced, and 75 per cent, of the destinations sought were not even opposed by the existence of " paper " licences.

For the respondents, Byrne Bros. (Leek), Ltd., and Potteries Motor Traction Co., Ltd., it was held that there 'had been a disastrous decline in demand for tours. The Railway Executive withdrew its objections to the application in the course of the hearing.

In his observations, Mr. J. M. Glen, of the Ministry of Transport, said there was no evidence of unsatisfied demand. The large number of destinations covered by existing licences held by the appellant suggested that there was no case for an extension of the list for miscellaneous destinations, "RUN LONGER BETWEEN DOCKS"
