Sole trader licence not specific enough for partnership so come clean, says TC

A HAULIER was called before a disciplinary inquiry after it emerged during a routine maintenance investigation that the business was operating as a partnership rather than the sole trader specified on its licence.
At the hearing in Leeds, North Eastern Deputy Traffic Commissioner Mark Hinchliffe granted David Henderson, trading as DC European Haulage of Amble, Morpeth, 14 days in which to submit an application for a fresh licence in the name of a partnership.
The one-truck operation specialises in household removals and Henderson's partners are his cousin George Moore, who drives the truck, and Moore's brother.
Hinchliffe ruled that it was important for TCs to know exactly who is running a business, in case there are any problems in the individuals' pasts that the TC should be aware ot Vehicle examiner John Johnson visited the premises in January and issued a delayed prohibition for a fractured brake disc after meeting the partners.
He was satisfied this work was carried out at the vehicle's next inspection five days later. Records showed inspections were carried out every four weeks and a driver defect reporting system was being used.
