CAR TRANSPORTER firm RGM Motors has been ordered to pay one of its former drivers over 110,000 in compensation for unfair dismissal.

Dennis O'Toole, who had less than two years' service with the firm, was dismissed via mobile phone by Robert Warburton, MD of Dorchesterbased RGM. after he failed to drive from Truro to Southampton in less than four hours — a distance of almost 200 miles.

Malcolm Williams, regional officer at the United Road Transport Union, says: "O'Toole had a number of arguments with his employer about his alleged 'poor productivity'. They were clearly expecting too much from him: but he was working within his legal parameters. The company failed to follow any disciplinary procedures or to attend its Southampton Employment Tribunal hearing. The whole experience has resulted in O'Toole changing his career, and the loss of yet another HGV driver from the industry."

RGM claimed that since January, when O'Toole was dismissed, it had not had enough time to prepare a defence. A RGM Motors spokeswoman says that the company has launched an appeal.
