AN interesting point arose recently when a haulier, a member of the Scottish Carriers' and Haulage Contractors' Association, delivered bags of cereals to a consignee and the driver and. mate were asked to carry the goods in. They did so and broke a window of the consignee's premises. The consignee reported to the factor who referred the matter to the insurance company who, in turn, claimed approximately £8 from the carrier in question. The haulier repudiated liability and defended an action in Court, The 'driver and mate stated that they were instructed, when handling large loans, to 'consider delivery made at the tail board of the vehicle and that only small loads should be delivered withoue instruction. Unfortunately, the agent for the insurance company could not find his witnesses and the Sheriff dismissed the action, so no decision has yet been given on the point.
