Which of the following most accurately describes the problem?

• Mr C. M. Sheridan, the East Midland LA, exercised his power under Section 69, last week in Nottingham, when he put a Radford haulage firm out of business by revoking its six-vehicle 0 licence.

The firm, G. and H. Pilkington, had been requested to attend the inquiry to show cause why its licence should not be curtailed, suspended or revoked, after the company had failed to provide adequate vehicle preventive maintenance. No representatives of the firm attended the inquiry but a letter was received by the LA in which the firm stated it no longer wished to keep its operator's licence and it added: "This has been the worst winter for work ever. With one restriction or another, the haulier has had it."

Referring to the licence the letter said: "The powers that be can suspend it, revoke it, or do what they like with the licence."

Earlier Mr R. Reynolds, a DoE vehicle examiner, told the LA that on November 9 last year he visited the firm's premises and met Mr A. Pilkington, transport manager. Mr Pilkington told him at this time that some maintenance work was carried out by the company and a self-employed man also maintained vehicles occasionally.

Mr Reynolds pointed out that he saw few maintenance records or drivers' defect sheets. He went on to say that one of the three vehicles examined was in such a condition that it had attracted an immediate GV9.
