TWO BROTHERS WITH a history of operating vehicles without an 0-licence must wait to learn if their latest 0-licence application has been successful.

Despite reserving his decision, West Midlands Deputy Traffic Commissioner Miles Dorrington said he is likely to grant an 0-licence to Birmingham-based Akhtar and lqbal Hussain, trading as MR Recovery Salvage. The authorisation will be conditional on providing evidence of adequate finance, but it is unlikely to meet MRs request for three vehicles. The partners had continued to operate after continuation was not sought in January 2009 for a licence held by Iqbal Hussain.

The DTC said he was concerned about a vehicle driven by Akhtar Hussain that was stopped last July when no 0-licence was in place. There were previous convictions against Iqbal Hussain for using more vehicles than were authorised on his national licence, and for using vehicles when no 0-licence was in force.

For the partners, Wykghen Garsia said their offences were largely due to a lack of knowledge.

The DTC pointed out that Akhtar Hussain had been stopped twice in 2008 and again in 2009.

Admitting that an 18-tonne car transporter had been used without an 0-licence, Akhtar Hussain said he had been driving for his brother, but the vehicle had not been used since.

Since 2004, they had been trading as recovery operators. He had not understood the law until he was stopped by the traffic examiner last July.

The other vehicle — a 7.5-tonner — had only been used for recovery work since. There had been no intention to beat or challenge the system, and Akhtar Hussain now understood what was required.

Asked why the car transporter was used after his 0-licence was not continued, Iqbal Hussain said there were a few jobs to finish.

The DTC warned that if an 0-licence was granted, it would be the partners' first and last chance.
