FTA head of engineering policy Andy Mair says: "If a vehicle examiner goes in to a company and does an audit, is there going to be a cut-off point where paperwork will no longer be acceptable?" Mair is also concerned by VOSA's response to CM, adding: "The problem is that the bestpractice guide is used as a benchmark, and although VOSA may claim it is not for them to say, they are setting the standard the industry is expected to follow. I am sure if VOSA comments that the inspection sheet does not match the best-practice guide, this will be taken into account by TCs accordingly."

The agency's response that it is only providing guidelines for best practice is described as "unreasonable" by Mike Oliver at Trans-Law. He adds: "It is also charged with enforcement, so if it is to insist upon best practice in accordance with its guidelines, [the agency] cannot sit on the fence when questions are asked and the issue of the transitional position raised."
