Which of the following most accurately describes the problem?

• An application bid by John Snarling for a new international licence for his company Pendas, trading as J P Spading of Huddersfield, has been adjourned by North Eastern Licensing Authority Frederick Whalley.

The court heard how Spading's previous company, J P Sparling, had been wound up in June/July 1986 by the Inland Revenue. The company had operated a selfemployed driver scheme, but there were problems over the payment of stamps by drivers, which led to a claim of £7,000 against the company by the Inland Revenue.

A writ issued by the Inland Revenue was not received because of the 1986 postal strike, and the company was wound up in the High Court without the knowledge of Spading or the company's solicitors.

Questioned by Whalley, Sparling said he was unable to give a lot of detail concerning the previous company's finances as its books were with the liquidator. He maintained, however, that the company would have shown a profit even after paying off the £7,000. All but one of the company's creditors had Legal been paid off, said Snarling. The remaining creditor would be paid as soon as an electrical fault on a vehicle had been repaired.

Whalley commented that the supplementary financial information provided was dated December 1986 and did not show the company's current position.

Adjourning the hearing for production of more upto-date information and a list of creditors of J P Spading, Whalley said he would consider granting the application in chambers without the need for a further public inquiry if the additional information was satisfactory.
