Which of the following most accurately describes the problem?

• St Helen's-based J K Phillips (Haulage Contractors) has been given six months in which to find a new transport manager by North Western Licensing Authority Roy Hutchings. The current transport manager, managing director John Phillips, is no longer of good repute Hutchings has decided, because of a conviction of handling a stolen excise licence.

The company holds a licence for 18 vehicles and 15 trailers. Though the imposition of 25 prohibitions (of which 16 were immediate) since Many 1977 would have merited the revocation of the licence, Hutchings decided not to make such a direction in view of the steps taken by the company to remedy the situation.

Two convictions for excise licence offences seem to indicate that there might be some financial problems, but having seen certified accounts for the year 1985/86 he was satisfied that the company was of appropriate financial standing.

Though Phillips had protested his innocence, he was convicted by St Helen's Magistrates of handling a stolen excise licence and fined 11 000.

His appeal against that conviction was rejected.
