A Worcestershire-based truck dealer has joined the long list of rental and finance companies which have had vehicles returned to them following seizure for unlicensed use.

Milbury Commercials, of Milbury Heath, Worts, sought the return of its vehicle at a Birmingham Public Inquiry. It had been seized by the Vehicle Inspectorate while it was being operated unlawfully by Wadborough-based UK Plant & Haulage Management.

UK Plant was also seeking the return of the vehicle, but West Midland Traffic Commissioner David Dixon refused to hear an application from John Bruce, representing that company, because he was neither a director nor the company secretary.

Milbury's MD, Ian Gribben, told the inquiry that he had not known UK Plant was operating the vehicle without an 0-licence. He said he had hired the vehicle to UK Plant after buying it in April from Volvo Financial Services.

In reply to the TC. Gribben said that there was no written hiring agreement: it had been a verbal arrangement for six months at a fee of /350 per week.

He said he had assumed that UK Plant had an 0-licence and claii to have seen other vehicles with 0-lic€ discs in the windscreen.

However, the TC pointed out that Plant & Haulage Management had ni held an 0-licence: its associated firm, Plant &, Haulage Services, had only interim authority to operate until its app on for an 0-licence was refused.

Directing that the vehicle be returne Milbury, the TC said that UK Plant was present to substantiate its claim to the cle and ee accepted that Milbury did know it was being operated withal licence.
