Which of the following most accurately describes the problem?

THE appeals by Golden Valley Trans' port Ltd., of Stoke Gifford, Gloucester, against the refusal by the Western Licensing Authority of two applications, have been dismissed by the Transport Tribunal in a reserved, written decision issued last week (see The Commercial Motor, November 19). The Tribunal endorsed the view of the LA that the "evidence shows that the appellant was not operating the vehicles in a lawful manner, in that there was no relationship of master and servant between the appellant and the drivers of the vehicles, and that the reality . . . was that the appellant had been operating an unusual type of clearing house ".
