West Midland Traffic Commissioner Nick Jones gave the firm Morwaste of Stoke on Trent the ultimatum after ruling that managing director Peter Moore, who had obtained his CPC through grandfather rights, had lost his repute as a transport manager. The TC also

curtailed the 0-licence from six to four vehicles.

Vehicle examiner Andrew Smith told a Birmingham disciplinary inquiry that he carried out an unannounced maintenance investigation in November following the issue of an immediate S-marked prohibition, indicating a serious lapse in maintenance, to a vehicle overdue its annual test. He examined three vehicles without the use of underneath inspection facilities and issued one delayed and two immediate prohibitions.

Inspection records available were minimal. Three vehicles had only been inspected once in a 15-month period. A fourth had four inspections, though two were on the same date. Only one driver defect report was available and that was outside the 15-month period. The initial failure rate at annual test was 100% and the final failure rate was 75%.

The TC said the periods between inspections were "staggering". He had never come across such periods between inspections and the fact these were skip vehicles was particularly concerning.

The company gave a series of undertakings in relation to its future vehicle maintenance arrangements.

The TC said it was possible to put the substantial failings down to the transport manager, and it was the transport manager who was the problem rather than the company.
