Which of the following most accurately describes the problem?

• Norfolk County Council is suing mill owner BOCM Paul for £330,000 for road repairs claiming "extraordinary usage" under the 1980 Highways Act.

At issue is the road which runs from BOCM Paul's animal feed mill at Burston near Diss, crosses the A140 Ipswich Road and serves the company warehouse on the other side.

The county council says there has been a substantial increase in HGV traffic using the road; BOCM Paul is contesting the claim. RHA technical consultant Maurice Vandome believes the case highlights a grey area of the law.

Companies can strengthen their position by ensuring they do not fall foul of the law by overloading vehicles.
