THE application of By-Pass Transport (St. Austell) Ltd. for a Bto A-licence conversion, with a change of base to Shepton Mallet (The Commercial Motor, December 24), has been refused by the Western Licensing Authority, Mr. J. K. C. SamuelGibbon.
In his reserved, written decision, the LA points out that none of the collection points specified in the published normal user (new and used vehicles from Oxford, Luton, Ellesmere Port and Ramsgate for delivery as required) was in the Western traffic area and the declaration left the points of delivery " entirely at large ".
The LA considered whether it would be proper to make a grant on a revised normal user for two of the three vehicles but he concluded that an A licence would be inappropriate " where considerations of geography would give rise to perplexing problems in connection with the doctrine concerning return loads ". Flexibility, he felt, could be better achieved by uniform B-licence conditions.
There was evidence of substantial returnload capacity by objectors, particularly from Southampton, which was "as relevant in connection with traffic originating at Ramsgate as are vehicles of the applicants at Shepton Mallet or on their way eastwards from Devon and Cornwall".
