Which of the following most accurately describes the problem?

A LICENSING Authority is not entitled to refuse an application on environmental grounds in respect of an existing operating centre even if it is new to the operator making the application.

This was made clear when Lancashire haulier Ken Abram sought Western LA Roy Hutchings' permission to change its operating centre.

But Mr Hutchings emphasised that the company had to show that there had been no material change in the use of the premises between its occupation and the previous occupier.

West Lancashire District Council opposed the application to change Abram's operating centre from Parbold, Wigan to a site in Rufford and there were representations from 18 local residents and Rufford Parish Council.

Granting the application, Mr Hutchings said it was his intention to impose environmental conditions on the licence. The company would be given notice of the proposed conditions and would have an opportunity of making representations against them.
