Department of Transport senior traffic examiner Anthony Smith said that he had carried out observations at the Moss Lane, Macclesfield operating centre of Cyril Henshaw, trading as Henshaws Waste Management Services, following complaints from local residents that the company was not sticking to conditions on operating times.

He found that at least one vehicle was being used on Sundays and bank holidays in contravention of the conditions.

When interviewed, Henshaw had admitted using one skip vehicle on most Sundays. On that particular Sunday he was about to use a second.

A short time afterwards a second skip vehicle left the premises, said Smith.

He added that Henshaw told him that it was necessary for him to operate on a Sunday and he had agreed to the time restrictions to avoid trouble.

The premises had been used as a transport depot for more than

30 years, said Smith, and had been used as such before the residential property on the opposite side of the road had been built

Henshaw said various environmental conditions had been imposed on the licence when the authorisation was increased from seven to 12 vehicles.

He had mistakenly believed that the conditions only applied to the extra vehicles.

His intention was to apply to vary the conditions to allow some movement on Sundays and bank holidays

Adjourning the proceedings pending the hearing of that application, North Western Deputy Traffic Commissioner Patrick Mulvenna warned that meanwhile the existing conditions still applied.
