WHEN convicted of traffic offences and disqualified from driving the holder of an hgv licence must surrender that licence to the Licensing Authority.

LAs were trying to get that point across, the Northern LA, Mr B. J. Foster, said on Monday. Appearing before him was Keith Thomas Barker of Newton Ayclisse, Co Durham, who was appealing against being disqualified from lorry driving until he had passed a test.

Mr Barker had been disqualified for two years in 1973 for driving a private car with an excess of alcohol in his blood. He said he had been driving hgv for a number of years and had had no accidents. He had lost nearly £1,200 in wages during his disqualification while kept on by his employer as driver's mate.

Mr Barker added that his ordinary driving licence was returned in May 1975 and he had driven a coal wagon until his 'hgv licence expired.

Asked if he had read the condition on the back of his hgv licence indicating that it must be returned after disqualification, Mr Barker said he had read it but did not take it in.

The LA said that if the licence •had been sent in it would have been revoked and Mr Barker would have been appearing as a new applicant instead of seeking renewal. On that basis a provisional licence would be granted and he must take a test.
