AN INDUSTRIAL Tribunal in Carlisle last week turned down the appeal of a lorry driver alleging unfair dismissal.

The appellant was Mr Peter Regan, of Egremont, West Cumbria, who was dismissed by M. J. Morgan and Sons, haulage contractors, Whitehaven, West Cumbria, just before Christmas.

His employer, Mr Michael Morgan, said Regan was absent from work for 24 days last year, apart from holidays and sickness, and was warned verbally several times and also by letter. In December, however, he rang two hours after he should have been at work to say his car had broken down and did not turn up at all that day.

Foreman fitter with Morgan's, Roy Sanderson said when Regan phoned, at 7.45 am, he was told to get to work when his car was fixed.

Regan told the Tribunal he had been unemployed since his notice expired in December and could not remember any verbal warnings.

The district secretary of the TGWU, Ronald Graham, said he had acted reliably and let the cc rnpany know when he was going to be absent.

The Tribunal found unanimously that Regan was not unfairly dismissed.
