• Sutton and Sons has been ordered to pay almost £90,000 compensation to a driver whose foot was badly crushed under a falling reel of paper, while doing contract work for the company.

Michael Scutts, 39, damaged his left foot so seriously in the accident that he was forced to give up driving tankers, an essential part of his work as a haulage contractor. Scutts now wears a surgical boot on his left foot and is unsteady and slow on his feet.

Scutts had been self employed since 1976, working partly for Sutton and Sons driving flat bed trucks and partly for another company driving tankers, which paid well.

In the High Court deputy judge Rayrnond Kidwel QC said, "If he had not had the accident be would have soon started looking around. I am quite satisfied the plaintiff could easily have found tanker work."

Nearly £67,362 of the .289,362 award was for Scutt's future loss of earnings as he is no longer able to drive tankers. Sutton and Sons of Palmers Wharf, oft Roman Road in Bethnal Green, admitted negligence but disputed the extent of Scutt's injuries.
